TERMS OF SERVICE

These Terms of Service ("Terms") govern your access to and use of the Enzo's at Home website and the products and services we offer, including one-time purchases and subscription-based deliveries. By accessing or using our website or purchasing our products, you agree to be bound by these Terms.

1. WHO WE ARE Enzo's at Home is an Australian business delivering fresh, handmade Italian meals. Our offerings include one-off orders and subscription meal boxes. References to "we", "us", or "our" in these Terms refer to Enzo's at Home.

2. ELIGIBILITY To use our services, you must be at least the age of majority in your jurisdiction. By placing an order, you confirm that you meet this requirement.

3. SUBSCRIPTION SERVICE TERMS When you sign up for a subscription, you authorise recurring charges to your nominated payment method. Subscriptions automatically renew at the frequency you selected unless cancelled in accordance with Section 4.

4. MANAGING OR CANCELLING A SUBSCRIPTION At any time you may pause, skip a delivery, or cancel your subscription by reaching out to us at info@enzosathome.com.au. Any modifications made to your subscription order via the customer portal will only take effect the following subscription cycle.

5. ORDERS AND DELIVERY You are responsible for ensuring your delivery details are accurate. Missed deliveries due to incorrect or incomplete information are non-refundable. If we are unable to fulfil your order (e.g. due to ingredient shortages), we reserve the right to cancel or substitute meals with a similar item.

6. PRICING AND PAYMENTS All prices are listed in AUD and inclusive of GST unless otherwise stated. We have a minimum order value of $89 AUD that must be met or exceeded before a customer can check out. We reserve the right to adjust pricing or delivery fees with reasonable notice. Payments for subscriptions are processed automatically on a recurring basis. Failed payments may result in cancellation or delay of service.

7. REFUNDS AND CREDITS We do not offer refunds for change of mind, incorrect orders, or missed deliveries due to customer error (such as an incorrect address or failure to collect the delivery). If your order arrives damaged, incorrect, or unsafe to consume, you must contact us within 48 hours of delivery with clear photos and your order number. Where appropriate, we may offer a store credit, replacement or refund. If a product fails to meet a consumer guarantee and the failure is major, you are entitled to choose between a replacement or refund. Credits are applied to your Enzo’s at Home website account and can be used on future purchases. Refunds, where approved, will be processed to the original payment method. Nothing in this policy limits your rights under the Australian Consumer Law. If a product fails to meet a consumer guarantee and the failure is major, you are entitled to a replacement or refund, at your election.

8. PROMOTIONS AND VOUCHERS Promotions, discounts, and vouchers are valid for limited times and only as stated. Vouchers are single-use, non-transferable, and not redeemable for cash. Referral credits may be revoked if used fraudulently or posted to third-party deal sites.

9. ACCOUNT RESPONSIBILITY You are responsible for maintaining the confidentiality of your account credentials. We are not liable for unauthorised use of your account. Notify us immediately of any suspected breach.

10. PRODUCT INFORMATION Meal descriptions and imagery are provided for general reference only. Ingredients and nutritional values may vary. You are responsible for checking all product information, including allergens and dietary suitability, before consumption.

11. LIMITATION OF LIABILITY To the maximum extent permitted by law, Enzo's at Home is not liable for indirect, incidental, or consequential damages arising from the use of our service. Our liability is limited to the amount paid for the affected product.

12. INTELLECTUAL PROPERTY All content on our website, including logos, recipes, text, and media, is our property or used under licence. You may not copy, reproduce, or exploit any part without prior written consent.

13. THIRD-PARTY SERVICES Our website may link to third-party websites or integrate tools operated by third parties. We are not responsible for their content or your use of those services.

14. PRIVACY Your personal information is collected, used, and stored in accordance with our Privacy Policy.

15. TERMINATION We reserve the right to suspend or terminate your account if you breach these Terms. We will make reasonable efforts to notify you of any potential breach and provide an opportunity to respond or rectify before suspending or terminating your account. You remain responsible for all outstanding charges up to the termination date.

16. CHANGES TO TERMS We may update these Terms from time to time. We will notify you of significant changes via email or by updating the website. Continued use of our services constitutes acceptance of the revised Terms.

17. FORCE MAJEURE We are not liable for failure to perform or delays due to causes beyond our reasonable control, including natural disasters, supplier issues, transportation interruptions, or government restrictions.

18. GOVERNING LAW These Terms are governed by the laws of South Australia, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts in that state.

19. LIRA LOYALTY PROGRAM Enzo’s at Home may offer customers the Lira Loyalty rewards program (“Program”) that allows members to earn points on qualifying purchases and promotional activities.

(a) Points have no cash or monetary value, are non-transferable, and may only be redeemed for rewards as described on our website. Points cannot be sold, exchanged, or refunded.

(b) We may, at our discretion, modify earn rates, redemption values, tier thresholds, or available rewards, provided that such changes will not reduce the value of points already earned prior to the effective date of change. We will provide reasonable notice of material changes on our website or by email.

(c) Points or rewards earned through error, misuse, or fraudulent activity may be cancelled.

(d) If the Program is discontinued, we will provide at least 30 days’ notice and allow a reasonable period for members to redeem remaining points before expiry.

(e) Participation in the Program constitutes acceptance of these Program terms in addition to our general Terms of Service. Nothing in this Program limits your rights under the Australian Consumer Law.
